A Community Member requests your support for the online petition “Vallco Shopping Mall: Remove Office Allocation and Restore Building Height”.

From the Petition: “We Are Community Members Who call for the City Council to reject the creation of a community-centered process on a plan for Vallco. Instead, we urge all Council Members to consider the following changes to the Cupertino General Plan for the Vallco Shopping Mall:

–  removal of the office allocation of 2 Million square feet
–  restoration of the maximum building height for new construction in place on December 3, 2014″


Background Story — History of the Vallco Site Zoning:

– Stage 1 (before December 4, 2014):
Retail only (No office building or housing allowed)

– Stage 2 (after the vote of GPA at about 2:00am, December 4, 2014):
Cupertino City Council voted after almost all the residents left the meeting room. The 4:1 voting result (only Darcy Paul voted No) marks the start of Vallco’s conditional rezone:

  1. Two Million square feet office allocated;
  2. Maximum building height changed to TBD

– Stage 3 (June, 2015):
Vallco EIR started under the conditional rezone.

– Stage 4 (April, 2016):
Vallco developer Sand Hill Property (SHP) Company started an initiative (Measure D) and put Vallco EIR on hold.

– Stage 5 (November, 2016):
Measure D failed, Cupertino residents used their votes to declare they don’t support a Vallco Plan with 2 Million square feet office and only 17% retail footage.

What’s the problem NOW?

The Conditional Rezone is still effective, which includes

  1. Two Million square feet office allocation;
  2. Maximum building height at Vallco site as TBD.

Cupertino City Council ignored residents’ request to get rid of the conditional rezone started on December 4, 2014. That means, the developer SHP can re-start the EIR process and submit a specific plan with 2 Million square feet office again, if they like.
